Please read these Terms carefully before using Posture Hero. By downloading or using the app, you agree to be bound by them. If you don't agree, please don't use the app.
Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Posture Hero ("we," "us," or "our") governing your access to and use of the Posture Hero mobile application and any related services (collectively, the "App").
By creating an account, downloading, installing, or using the App, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Use of the App
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.
You agree not to:
- Copy, modify, distribute, sell, or sublicense any part of the App
- Reverse engineer, decompile, or attempt to extract the source code
- Use the App for any unlawful purpose or in violation of any applicable laws
- Interfere with or disrupt the integrity or performance of the App or its servers
- Attempt to gain unauthorized access to any part of the App or its related systems
- Use automated scripts or bots to interact with the App
We reserve the right to suspend or terminate access for anyone who violates these rules.
Your Account
Some features of Posture Hero may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to provide accurate, current, and complete information during registration and to update it as necessary. Notify us immediately at hello@posturehero.app if you suspect unauthorized use of your account.
We reserve the right to disable any account that we believe, in our sole discretion, has violated these Terms.
Health Disclaimer
Posture Hero is a wellness tool, not a medical device. The App is not intended to diagnose, treat, cure, or prevent any medical condition or injury.
The posture feedback, reminders, and tips provided by the App are for general informational and habit-building purposes only. They do not constitute medical advice.
If you experience pain, discomfort, or any medical symptoms related to your posture or musculoskeletal health, please consult a qualified healthcare professional before relying on any guidance from the App. Always use the App in a safe environment where looking at your screen does not create a hazard.
Subscriptions & Billing
Posture Hero may offer free and paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or annual) through the Apple App Store or Google Play Store, depending on your platform.
Key billing terms:
- Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
- Cancellation: You may cancel at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the paid period — we do not offer pro-rated refunds for partial periods.
- Free trials: If a free trial is offered, any unused portion is forfeited when you purchase a paid subscription.
- Price changes: We may change subscription prices with reasonable advance notice. Continued use after a price change constitutes your acceptance of the new price.
All billing is managed by Apple or Google. We do not store your payment information directly. For refund requests, please contact the relevant platform's support.
Intellectual Property
The App, including its name, logo, design, text, graphics, software, and all other content, is owned by or licensed to Posture Hero and is protected by copyright, trademark, and other applicable intellectual property laws.
You may not use the Posture Hero name, logo, or any App content for commercial purposes without our prior written consent. Any feedback or suggestions you provide about the App may be used by us without obligation to you.
Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what data we collect, how we use it, and your rights regarding your personal information.
By using the App, you consent to the data practices described in the Privacy Policy. The App uses your device's motion sensors (accelerometer/gyroscope) solely to detect posture in real time. Sensor data is processed on-device and is not transmitted to our servers unless you explicitly enable cloud sync features.
Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content or posture guidance provided by the App.
Limitation of Liability
To the maximum extent permitted by applicable law, Posture Hero and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $10 USD.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
Termination
You may stop using the App at any time by deleting it from your device and cancelling any active subscriptions through your platform's account settings.
We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. Upon termination, your license to use the App ceases immediately. Sections 6, 7, 8, 9, and this section survive termination.
Changes to Terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page and, for material changes, notify you via in-app notice or email.
Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you don't agree to the updated Terms, please stop using the App and cancel any active subscription.
